BUYER / CUSTOMER
The natural person completing the booking form ("the Customer").
1. Subject of the Agreement
This agreement governs the terms of the package tour service purchased by the Customer through the AlaTourqo platform. Full details of the tour — including departure date, duration, accommodation, transport, meals and price — are set out in the Reservation Confirmation. Tour organisation and execution is carried out by JOY DEEP TRAVEL TURİZM TİC. LTD. ŞTİ.
2. Pre-Contractual Information
In accordance with Article 48 of Law No. 6502 and Article 5 of the Distance Sales Contracts Regulation, the Customer has been informed via durable medium before payment of: tour operator identity and contact details; essential service characteristics; total price including all taxes; payment terms; cancellation, withdrawal and refund conditions; dispute resolution mechanisms. By completing the reservation, the Customer confirms receipt of this information.
3. Payment Terms
3.1 Deposit and Remaining Balance A minimum deposit of 50% of the tour price is required to open a reservation. The remaining balance must be paid at least 30 days before departure. Failure to complete payment within this period entitles the Agency to cancel the reservation; cancellation charges under Article 7 will apply.
3.2 Bookings Within 30 Days of Departure For bookings made within 30 days of departure, full payment is required at the time of booking, regardless of payment method.
3.3 Payment Notification For bank transfers, the Customer must upload the payment receipt via My Bookings. Payments will not be processed without this notification.

4. Booking Confirmation and Tour Voucher
A reservation is confirmed only upon written confirmation by the Agency. The tour voucher is issued only after full payment is received. Participation in the tour is conditional upon complete payment; entry to transport, accommodation and tour sites may be refused if the voucher has not been issued due to outstanding payment.
5. Passenger Details and Name Changes
5.1 Submission of Passenger Information All passenger details — including passport information — must be entered in full via My Bookings at least 21 days before departure. Failure to do so may result in the passenger being unable to join the tour; the Agency bears no liability for any resulting loss.
5.2 Name Changes Name changes may be requested up to 21 days before departure at no charge. Name changes with fewer than 21 days remaining cannot be accommodated due to operational constraints with accommodation providers and official registrations.
6. Transfer of Booking
The Customer may transfer their booking to a third party provided written notice is given at least 7 days before departure. The transferring and receiving parties are jointly and severally liable for any outstanding balance and transfer costs. Transfers are not permitted with fewer than 7 days remaining.
7. Cancellation by the Customer

Cancellation requests must be submitted in writing only ([email protected] or WhatsApp) and must include the booking reference number. The date the Agency receives written notice determines which period applies.
8. Cancellation by the Agency
The Agency may cancel due to insufficient participants (minimum 6 persons), force majeure or safety concerns. In such cases, the Customer will be offered a full refund of all amounts paid or an alternative departure date at no extra cost. No further compensation is payable.
9. Programme Changes
The Agency may modify hotels, transport, times or tour sequence where operationally necessary, with at least 24 hours' notice for domestic tours and 48 hours for international tours. Accommodation standard and night count may not be reduced without the Customer's consent or a proportionate refund.
10. Right of Withdrawal
This agreement relates to accommodation, transport and leisure services provided on specific dates and is therefore exempt from the 14-day right of withdrawal (Distance Sales Contracts Regulation, Art. 15/1-g). Where no payment has been made and within 14 days of confirmation, the Customer may cancel in writing free of charge; where payment has been made, Article 7 applies.
11. Force Majeure
The Agency shall not be liable for any failure to perform obligations under this agreement resulting from circumstances beyond its reasonable control, including natural disasters, extreme weather, political events, pandemics, strikes, civil disturbance or acts of third-party transport providers. In such circumstances, an alternative departure date will be proposed; cancellation fees may be waived at the Agency's discretion.
12. Luggage
Customers are responsible for their own luggage throughout the tour. Valuables, cash and documents should not be placed in checked baggage or left unattended. The Agency accepts no liability for loss, theft or damage to personal belongings unless caused by the proven negligence of AlaTourqo staff.
13. Insurance
Package tour customers are covered by mandatory package tour liability insurance under Turkish law (Law No. 1618, Art. 12); coverage is limited to the tour price paid. Personal travel insurance covering medical emergencies, trip cancellation and personal belongings is strongly recommended. AlaTourqo accepts no liability for costs arising from the absence or inadequacy of personal travel insurance.
14. Complaints
Any problem arising during the tour must be reported immediately in writing to the Agency representative and, where applicable, to the accommodation provider at the time. Failure to report a problem during the tour may reduce or extinguish the right to claim compensation after the fact. Post-tour complaints must be submitted in writing to [email protected] within 30 days of the tour end date. Complaints received outside this window may not be accepted.
15. Dispute Resolution
Consumer disputes may first be referred to the Consumer Arbitration Committee within applicable monetary limits under Turkish law. Higher-value disputes fall under the jurisdiction of Consumer Courts. This agreement is governed by Turkish law; other disputes are subject to the exclusive jurisdiction of Ankara courts and enforcement offices.
16. Personal Data Protection (KVKK / PDPL)
16.1 Data Controller Joy Deep Travel Turizm Tic. Ltd. Şti. is the sole data controller for all personal data processed in connection with bookings and tour operations, including biometric data shared with hotels, transport providers, insurers, ministries and official bodies.
16.2 Data Transfers Joy Deep Travel Turizm Tic. Ltd. Şti. may transfer personal data to service providers and official bodies solely to the extent necessary for service delivery. All transfers are conducted under Articles 8–9 of KVKK No. 6698.
16.3 Retention and Deletion Personal data is deleted or anonymised once statutory retention obligations expire. Credit card details are not stored under any circumstances.

17. Formation of the Agreement
This agreement is concluded upon the Customer completing the reservation and confirming payment. By completing the reservation, the Customer declares that they have read, understood and accepted all provisions herein.
